Service Level Agreement (SLA) for Rochester Free Websites
This Service Level Agreement (“SLA”) is made between Rochester Free Websites and [Customer] (hereinafter referred to as “Customer”).
Service Availability:
Rochester Free Websites guarantees that its hosting services will be available 99.9% of the time each month, excluding scheduled maintenance or forced major events.
Support:
Rochester Free Websites provides customer support via email and phone. Support requests will be addressed within 24 hours of receipt, except on weekends and holidays, in which case support will be provided on the next business day.
Website Backup:
Rochester Free Websites will perform backups of customer websites to ensure that data is not lost in the event of a system failure.
Security:
Rochester Free Websites will take reasonable measures to ensure that customer data is protected against unauthorized access or theft. However, it is the responsibility of the customer to maintain secure access to their website, including strong passwords and keeping software up to date.
Free Website Offer:
Rochester Free Websites offers a free website to customers who purchase hosting services for a minimum of 12 Months. The website will be designed and built by Rochester Free Websites based on the agreed upon requirements.
If hosting service is cancelled prior to the minimum 12 month subscription, the website and all contents, and intellectual property contained within stay the property of Rochester Free Websites. The website may be purchased for use or hosting elsewhere for a cost of $1500.00.
After 12 months of hosting service the website may be transferred or migrated. The customer is responsible for all costs and labor for the transferring or migration of site using a third party representative. If requested, Rochester Free Websites will gladly help with the migration process for $500.
If hosting service is cancelled prior to the minimum 12 month subscription, the website and all contents, and intellectual property contained within stay the property of Rochester Free Websites. The website may be purchased for use or hosting elsewhere for a cost of $1500.00.
Payment Terms:
The client agrees to pay the hosting fees as outlined in the selected hosting plan, as well as any additional fees for extra services. This may include the purchase of a Domain Name, if one is not already been purchased by customer.
Payment Method:
Payment shall be made by the client via credit card.
Payment Schedule:
The customer’s credit card will be billed for hosting fees on a monthly basis. Any additional fees for extra services shall be paid immediately upon invoicing.
Late or None Payment:
Rochester Free Websites reserves the right to suspend or terminate the hosting service if payment is not received. The website and all contents, and intellectual property contained within the site may be withheld until account is made current.
Refunds:
The hosting company offers a 30-day money-back guarantee. If the client is not satisfied with the hosting service, they may request a refund within the first 30 days of the service activation. After that period, no refunds shall be given for any reason.
Limitation of Liability:
Rochester Free Websites is not liable for any damages arising from the use or inability to use its hosting services, including but not limited to lost profits or data. The maximum liability of Rochester Free Websites shall not exceed the total amount paid by the customer for hosting services in the 12 months preceding the incident.
By completing the purchase from Rochester Free Websites, the customer is agreeing to this SLA, the customer acknowledges that they have read and understand the terms and conditions outlined herein and agree to be bound by them.
SLA Changes:
Rochester Free Websites has the right the change or alter the SLA without prior notice.
